Terms and Conditions
K12 Talent Terms of Service
Agreement to these Terms
These Terms of Service ("Terms") govern your use of k12-talent.com and all related services (together, "K12 Talent" or the "Services"). K12 Talent is a service operated by K12 Data, Inc., a California corporation ("K12 Talent," "we," "us" or "our").
By creating an account, posting a job, uploading a resume, purchasing a service, or otherwise using K12 Talent, you agree to these Terms. If you use K12 Talent on behalf of a school, district, college, company or other organization, you confirm you are authorized to accept these Terms for that organization, and "you" includes that organization. If you do not agree, do not use K12 Talent.
We may update these Terms from time to time. We will post the updated version on this page with a new effective date, and we will give registered users reasonable notice of material changes. Continued use after the effective date means you accept the updated Terms.
1. The Services
K12 Talent is an online hiring platform for K-12 schools, districts, colleges, education organizations and education companies ("Employers"), and for education professionals seeking work ("Job Seekers"). The Services include free job posting, job search, resume upload and search, paid job post upgrades, newsletter promotion, and targeted email outreach to education professionals.
We may add, change, suspend or discontinue any part of the Services at any time. We will use reasonable efforts to notify affected paying customers of material changes.
Some job listings on K12 Talent are gathered from publicly available sources and rewritten for our site. These listings are marked as unclaimed. An Employer may claim its listing, request changes, or request removal by contacting us.
2. Accounts
- You must be at least 18 years old to create an account.
- You must give accurate, current information and keep it up to date.
- You are responsible for your login credentials and for all activity on your account. Tell us right away if you suspect unauthorized use.
- One person or organization may not create multiple accounts to get around limits or a suspension.
3. Employer Terms
If you post jobs or use our recruiting services, you agree that:
- Every job you post is a real, current opening that you are authorized to fill or recruit for.
- Your postings are accurate and not misleading about the role, pay, location, employer or requirements.
- You comply with all applicable employment laws, including equal employment opportunity and anti-discrimination laws. You will not post jobs that discriminate based on race, color, religion, sex, sexual orientation, gender identity, national origin, age, disability, veteran status or any other protected characteristic, except where the law allows.
- You will not ask Job Seekers for payment, bank details, Social Security numbers or other sensitive information as a condition of applying.
- You will use Job Seeker information only to recruit for real openings at your organization. You will not sell, share or reuse it for marketing or any other purpose.
- You are solely responsible for your hiring decisions, background checks, and compliance with credential and licensing requirements.
K12 Talent does not guarantee any number of applicants, responses or hires.
4. Job Seeker Terms
If you search for jobs or upload a resume, you agree that:
- The information in your profile and resume is accurate and belongs to you.
- You will not upload content that contains another person's personal information without their permission.
- You choose your resume's visibility settings. Depending on your settings, registered Employers may be able to view your resume and contact you.
K12 Talent does not employ Job Seekers, does not act as an employment agency, and does not guarantee interviews, offers or employment. We do not verify every Employer or listing. Use good judgment, and never send money or sensitive personal information to apply for a job. Report suspicious listings to us.
5. Targeted Outreach and Newsletter Promotion
When you purchase targeted outreach, K12 Talent sends email about your opening to education professionals you select by role and region, on the date you choose. We write, send and manage these emails on your behalf. You approve the job content; we control the sending, list selection and compliance with email laws, including CAN-SPAM.
Any contact information included in your campaign report is provided only so you can follow up on that recruiting campaign. You may use it only for recruiting within your own organization. You may not sell, license, share, publish or transfer it to anyone else, or add it to any marketing list.
Newsletter placements appear in a scheduled K12 Talent newsletter. Placements are limited and are scheduled in the order purchased.
We do not guarantee open rates, response rates, applicants or hires from any outreach or promotion.
6. Fees and Payment
- Basic job posting is free.
- Paid services, including Boost upgrades, newsletter placements and targeted outreach, are priced as shown on our website or in a written quote at the time of purchase.
- Payment is due at purchase unless we agree otherwise in writing. Prices do not include taxes; you are responsible for any applicable taxes.
- All sales are final. Fees are non-refundable once a Boost is active, a newsletter has been sent, or an outreach campaign has been deployed. If we cancel a paid service before it starts, we will refund what you paid for it.
- Unpaid balances may be charged interest at 1.5% per month or the highest rate allowed by law, whichever is lower, plus reasonable collection costs and attorneys' fees.
7. Your Content
You own the job postings, resumes, profiles and other content you submit ("Your Content"). You give K12 Talent a non-exclusive, royalty-free, worldwide license to host, display, format, distribute and promote Your Content in connection with the Services, including in search results, newsletters, email outreach and job feeds. This license ends when you remove Your Content or close your account, except for copies already sent or reasonably kept in backups.
You are responsible for Your Content. We may review, edit for formatting, decline or remove any content that violates these Terms or that we reasonably believe is harmful, misleading or unlawful.
8. Privacy
Our Privacy Policy explains how we collect, use and share personal information, and the rights California residents and others have over their information. By using K12 Talent, you acknowledge our Privacy Policy.
9. Prohibited Uses
You may not:
- Post fake, misleading or discriminatory jobs, or jobs for pyramid schemes, commission-only schemes presented as salaried roles, or any unlawful work.
- Use the Services to send spam or unsolicited marketing, or contact Job Seekers for anything other than a real job opportunity.
- Scrape, crawl, copy or harvest jobs, resumes, profiles or contact information, by automated means or otherwise.
- Resell, sublicense or share access to the Services or any data obtained through them.
- Impersonate any person or organization, including K12 Talent staff.
- Upload viruses or harmful code, try to bypass security, or interfere with the Services.
- Use the Services in violation of any law, including privacy, employment, anti-spam and export laws.
10. Intellectual Property
K12 Talent, its logo, website, software, design and content (other than Your Content) are owned by K12 Data, Inc. or its licensors and are protected by law. We grant you a limited, revocable, non-transferable right to use the Services for their intended purpose under these Terms. If you send us suggestions or feedback, we may use them without any obligation to you.
11. Suspension and Termination
You may close your account at any time. We may suspend or terminate your account, remove your content, or refuse service if you violate these Terms, misuse the Services, or create risk or legal exposure for us or other users. Fees already paid are not refunded on termination for violation of these Terms.
Sections 3.5, 5 (use of contact information), 6, 7, 9, 10, and 12 through 16 survive termination.
12. Disclaimer of Warranties
The Services are provided "as is" and "as available," without warranties of any kind, express or implied, including warranties of merchantability, fitness for a particular purpose, title and non-infringement. We do not warrant that the Services will be uninterrupted or error-free, that listings or profiles are accurate, or that any Employer or Job Seeker is who they claim to be.
13. Limitation of Liability
To the fullest extent allowed by law, K12 Talent and K12 Data, Inc. will not be liable for any indirect, incidental, special, consequential or punitive damages, or for lost profits, revenue, data or business opportunities, arising from or related to the Services or these Terms, even if advised of the possibility of such damages.
Our total liability for any claim related to the Services or these Terms will not exceed the greater of (a) the fees you paid us in the 12 months before the claim arose, or (b) one hundred dollars ($100).
K12 Talent is not a party to any relationship between Employers and Job Seekers and is not liable for their acts, statements, hiring decisions or employment terms.
14. Indemnification
You agree to defend, indemnify and hold harmless K12 Talent, K12 Data, Inc. and their officers, employees and contractors from any claims, damages, losses and expenses (including reasonable attorneys' fees) arising from Your Content, your use of the Services, your hiring practices, or your violation of these Terms or any law.
15. Assignment
You may not assign or transfer these Terms without our written consent. We may assign or transfer these Terms, in whole or in part, including to an affiliate or to a successor in connection with a merger, acquisition, reorganization or sale of the K12 Talent business or its assets, by giving notice to registered users or posting notice on the website.
16. General

- Attorneys' fees. In any action to enforce these Terms, the prevailing party may recover reasonable costs and attorneys' fees.
- Entire agreement. These Terms, the Privacy Policy, and any written order or quote for paid services are the entire agreement between you and us about the Services.
- Severability. If any provision is found unenforceable, it will be limited to the minimum extent necessary and the rest stays in effect.

- Force majeure. We are not liable for delays or failures caused by events beyond our reasonable control.
- Notices. We may send notices to the email on your account. You may send notices to us at [support email].
